PAYMENTS:
Packages consist of a four-day, three-night, all-inclusive stay at a LUXURIOUS RESORT, admission to all Carnival En events, and transportation to and from Carnival En events where applicable.
A minimum payment is due to secure your registration via the carnivalen.com payment platform. Package balances may be paid in full 2 weeks prior to the event start date.
Carnival En packages do not include airfare to and/or from our destination.
The Carnival En Management Team retains the right to charge an administrative fee, which shall not exceed 20% of the registration fee.
CANCELLATION AND REFUNDS:
If you are not able to travel for any reason, including but not limited to personal illness, manmade or natural disasters, you will have up to 2 years to reserve for a future date. Your funds will be forwarded to a future trip less your deposit and cancellation fees imposed by vendors related to your rescheduled trip.
All cancellation requests must be made in writing and submitted to the Carnival En Management team via info@carnivalen.com. Cancellation dates shall be determined by the date an attendee’s writing is received by the Carnival En Management Team. Verbal cancellations shall not be binding.
In the event of the happening of any circumstance beyond the control of the Carnival En Management Team, including without limitation, acts of God, fire, flood, natural disaster, war or threat of war, acts or threats of terrorism, civil disorder, unauthorized strikes, governmental regulation or advisory, recognized health threats as determined by the World Health Organization, the Centers for Disease Control, or local government authority or health agencies (including but not limited to the health threats of COVID-19, H1N1, or similar infectious diseases), curtailment of transportation facilities, or other similar occurrence beyond the control of the Carnival En Management Team, where any of those factors, circumstances, situations, or conditions or similar ones prevent, dissuade, or unreasonably delay prospective attendees from appearing at the Hotel, or where any of them make it illegal, impossible, inadvisable, or commercially impracticable to hold the Event, The Carnival En Management Team retains the right to unilaterally cancel or postpone the event without liability, damages, fees, or penalty. In the event of cancellation by Carnival En one month before the scheduled event, attendees shall be entitled to a refund in the amount of all deposits paid-to-date less an administrative fee equal to 20% of the attendee’s registration fee. In the event of cancellation by Carnival En within 30 days of the event start date, reasonable efforts will be made by Carnival En to reschedule the event and all packages will be honored for said new dates.
NO SHOWS/EARLY CHECKOUTS
Refunds or Credits will not be issued for No Shows or Early checkouts and 100% of all payments to date will be assessed.
COVID-19 POLICY
All Attendees must undergo COVID-19 testing (PCR or Antigen) within three calendar days of the scheduled event, and provide proof of negative test results to the “Carnival En” Management Team prior to travel.
Effective January 26, 2021, the Centers for Disease Control and Prevention (CDC) requires all air passengers entering the United States (including U.S. citizens and Legal Permanent Residents) to present a negative COVID-19 test, taken within one calendar day of departure. As guests of our destination resort, attendees will have access to on-site COVID-19 antigen testing prior to their return to the U.S. Testing will be provided by an accredited medical testing lab that complies with the requirements of the CDC and results will be received prior to departure in written and/or electronic format.
CONSENT TO THE USE OF PHOTOGRAPHIC IMAGES
Registration with, attendance at, or participation in Carnival En constitutes an agreement by the registrant/attendee to the Carnival En Management Team’s use and distribution (both now and in the future) of the registrant’s/attendee’s image or voice in photographs, videotapes, electronic reproductions, and audiotapes.
WAIVER OF LIABILITY AND RELEASE
In consideration for being allowed to participate in Carnival En, attendees hereby warrant and represent that they are age 18 or above and knowingly release, waive, discharge and covenant not to sue Carnival En, its Management Team, and each of their respective partners, shareholders, affiliates, directors, officers, fiduciaries, employees, agents and volunteers and each of the partners, shareholders, affiliates, directors, officers, fiduciaries, employees and agents of each of the foregoing (hereinafter referred to as “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by attendees or any of the property belonging to attendees, whether caused by the negligence of the Releasees, while participating in Carnival En or while in, on or upon the premises where Carnival En and/or related activity is being conducted.
Attendees hereby warrant that they are fully aware of the risks involved and hazards connected to their participation in Carnival En, including but not limited to travel risks. Attendees hereby elect to voluntarily participate in said activity with full knowledge that said activity may be hazardous to attendees and their property. Attendees knowingly and voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by attendees, or any loss or damage to property owned by attendees, as a result of being engaged in Carnival En, whether caused by the negligence of Releasees or otherwise. Attendees further hereby agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to attendees’ participation in Carnival En, whether caused by the negligence of Releasees otherwise.
Attendees knowingly and voluntarily intend for this Waiver of Liability and Hold Harmless Policy to constitute an Agreement between Releasees and attendees. Attendees knowingly and voluntarily intend for this Waiver of Liability and Hold Harmless Agreement to binding the members of attendees’ families and spouses if attendees are alive, and attendees’ heirs, assigns, and personal representatives if attendees are deceased, and knowingly and voluntarily intend for this Waiver of Liability and Hold Harmless Agreement to be deemed as a release, waiver, discharge, and covenant not to sue the RELEASEES. Attendees hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of New York.
INDEMNIFICATION
Attendees hereby warrant and represent that they are age 18 or above and hereby knowingly and voluntarily agree to indemnify, exonerate and hold Carnival En, its Management Team, and each of their respective partners, shareholders, affiliates, directors, officers, fiduciaries, employees, agents and volunteers and each of the partners, shareholders, affiliates, directors, officers, fiduciaries, employees and agents of each of the foregoing (collectively, the “Indemnitees”) free and harmless from and against any and all actions, causes of action, suits, losses, liabilities and damages, and expenses in connection therewith, including without limitation reasonable attorneys’ fees and disbursements (collectively, the “Indemnified Liabilities”), incurred by the Indemnitees or any of them as a result of, or arising out of, or relating to the execution, delivery, performance, enforcement or existence of Carnival En or the transactions contemplated hereby, whether caused by the negligence of the Indemnitees or otherwise.
